Terms of Service
Last updated: May 20, 2026
These Terms of Service ("Terms") govern your use of Fairily's event management platform and related services (collectively, the "Service") operated by Fairily ("we," "our," or "us").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Service.
Service Description
Fairily provides a comprehensive platform for managing booth-based events, including markets, fairs, festivals, and similar gatherings:
- Event creation and management tools for organizers
- Vendor application and booth assignment systems
- Payment processing for application fees and booth payments
- Communication tools between organizers and vendors
- Event tracking and management tools for vendors
- Digital booth layout and venue management
- Embeddable event widgets that organizers may place on their own websites
Some features of our Service, including the vendor application and event information widgets, may be embedded on third-party websites operated by event organizers. When you interact with an embedded Fairily widget, you are using our Service and these Terms apply, even though the widget appears on another website. The third-party website's own terms and privacy practices may also apply to your visit to that site.
User Accounts and Registration
Account Creation
To use certain features of our Service, you must create an account. You may register as either an Organizer or Vendor:
- Organizer Accounts: For event organizers managing booth-based events such as markets, fairs, and festivals
- Vendor Accounts: For artisans, crafters, and business owners participating in events
You must be at least 18 years of age to create an account or use our Service.
Account Responsibilities
You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Keeping your account information up to date
Account Inactivity
If your account has no login activity for a continuous period of two (2) years, we may classify it as inactive. Before taking any action, we will attempt to notify you at the email address on file. If the account remains inactive for 30 days after notification, we may permanently delete the account and its associated data. If your account is linked to active events, outstanding payments, or unresolved disputes, it will not be deleted until those matters are resolved.
Account Termination
You may terminate your account at any time through your account settings or by contacting us. We may suspend or terminate your account if you violate these Terms or engage in harmful conduct.
User Types and Responsibilities
Event Organizers
As an organizer, you agree to:
- Provide accurate event information and requirements
- Honor commitments made to vendors through the platform
- Handle vendor communications professionally and timely
- Comply with applicable laws and regulations for your events
- Pay all fees according to your selected pricing plan
- Maintain appropriate insurance and permits for your events
- Handle vendor selections and rejections fairly and professionally
Vendors
As a vendor, acceptance into an event represents a commitment to both the organizer and the other vendors participating in that event. Organizers rely on confirmed vendors to plan booth layouts, market the event, and coordinate logistics. Failure to honor your commitments can cause significant harm to organizers and other participants.
Attendance and Participation
As a vendor, you agree to:
- Attend and participate in every event you have been accepted to, for the full duration specified by the organizer. If you are unable to attend, you must make a good-faith effort to notify the organizer as early as possible through the platform so they can make alternative arrangements.
- Arrive on time for setup and remain through the designated event hours unless excused by the organizer
- Comply with all event rules, booth requirements, and organizer instructions, including setup, teardown, and conduct guidelines
- Sell only the products or services described in your application and approved by the organizer — do not substitute, add, or significantly change your offerings without the organizer's prior consent
Payments and Fees
- Pay all application fees and booth fees by the deadlines set by the organizer
- Understand that failure to pay by the stated deadline may result in loss of your booth assignment at the organizer's discretion
- Acknowledge that application fees are generally non-refundable once your application has been reviewed
Withdrawals and Cancellations
If you need to withdraw from an event after being accepted, you must notify the organizer through the platform as early as possible. Late withdrawals and no-shows harm organizers and may result in:
- Forfeiture of any fees already paid
- Reduced standing in future applications to that organizer's events
- Suspension or termination of your Fairily account in cases of repeated no-shows or pattern of late withdrawals
Whether any fees are refunded upon withdrawal is at the sole discretion of the event organizer. Fairily does not determine, mediate, or guarantee refunds between vendors and organizers.
Accurate Representation
- Provide truthful and accurate information in your vendor profile, applications, and all communications with organizers
- Accurately represent your products, business, and any certifications or licenses — misrepresentation may result in removal from events and suspension of your account
- Maintain all business licenses, permits, and insurance required by applicable law and by the events you participate in
Professional Conduct
- Communicate respectfully and professionally with organizers and other vendors
- Respect the intellectual property rights of others, including other vendors at the same event
- Represent yourself and your business in a manner consistent with the standards of the events you attend
Payment Terms
Fairily's Role in Payments
Fairily facilitates payments between vendors and organizers but does not hold, escrow, or otherwise control funds. Payments made by vendors are transmitted directly to organizers through our third-party payment processor, Stripe. Fairily is not a party to the financial relationship between organizers and vendors, and does not guarantee the performance, delivery, or quality of any event or services paid for through the platform.
Organizer Pricing
Organizer accounts are subject to subscription fees as described on our pricing page. Fairily reserves the right to update pricing with reasonable advance notice to affected users. Subscription fees are non-refundable except as required by law. If you cancel a subscription, you will retain access through the end of your current billing period.
Platform Service Fees
Fairily may collect a service fee or commission on transactions processed through the platform. Any applicable platform fees will be clearly disclosed to both the organizer and vendor at the time of transaction before payment is confirmed.
Vendor Accounts
Vendor accounts are free to create and use. Vendors may be required to pay fees set by individual event organizers, as described below.
Event Fee Types
Organizers may charge vendors the following types of fees through the platform:
- Application Fees: A fee charged at the time a vendor submits an application to participate in an event. Application fees are generally non-refundable once the application has been reviewed, regardless of whether the vendor is accepted or rejected, unless the organizer specifies otherwise.
- Booth Fees: A fee for the vendor's assigned booth or space at an event. Booth fees are due by the deadline set by the event organizer. The due date is displayed to the vendor at the time of booth assignment and in their event dashboard.
- Supply Fees: Fees for optional equipment or supplies provided by the organizer, such as tables, chairs, or electrical access. Supply fees are charged only when a vendor requests these items through the application or registration process.
All fee amounts, terms, and deadlines are set solely by the event organizer. Fairily does not control or influence the pricing decisions of organizers.
Payment Deadlines
Vendors are responsible for making payments by the deadlines set by event organizers. If a vendor fails to pay a booth fee by the stated deadline, the organizer may, at their sole discretion, revoke the vendor's booth assignment, reassign the booth to another vendor, or grant an extension. Fairily does not automatically cancel or modify a vendor's participation based on missed payment deadlines — these decisions are made by the organizer.
Payment Processing
All payments are processed through Stripe. By using our payment services, you also agree to Stripe's terms and conditions. Payment processing fees charged by Stripe are disclosed at the time of transaction.
Organizer Payment Obligations
Organizers who collect payments through the platform agree to:
- Clearly communicate all fees, deadlines, and payment terms to vendors before payment is due
- Honor booth assignments and event participation for vendors who have paid in full
- Establish and communicate a refund policy for their events
- Process refunds in a timely manner when required by their stated policy or applicable law
Refunds and Event Cancellations
Refund policies for event-related fees (application fees and booth fees) are established by individual event organizers. Organizers are required to communicate their refund policy to vendors before collecting payment.
If an organizer cancels an event after collecting fees from vendors, the organizer is solely responsible for issuing refunds in accordance with their stated refund policy and applicable law. Fairily does not control, guarantee, or process refunds on behalf of organizers. If you are a vendor and believe an organizer has failed to honor their refund obligations, you may contact us to report the issue, but resolution of payment disputes between organizers and vendors is ultimately between those parties.
Chargebacks and Disputes
If a payment dispute or chargeback is initiated through your payment provider, the relevant party (organizer or vendor) is responsible for responding to and resolving the dispute. Fairily may provide transaction records to assist in dispute resolution but is not liable for the outcome of any chargeback or payment dispute.

Feedback and Suggestions
If you provide us with feedback, suggestions, ideas, or feature requests regarding our Service ("Feedback"), you grant Fairily a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that Feedback into our Service without any obligation or compensation to you. You acknowledge that Fairily may already be developing similar features independently and that submission of Feedback does not create any confidential relationship or obligation.
Confidentiality Between Users
Through the use of our Service, organizers and vendors may gain access to each other's business information, including but not limited to contact details, product information, pricing, sales data, event logistics, and booth layout details. You agree to:
- Use information obtained about other users solely for purposes related to the events and transactions facilitated through our platform
- Not disclose another user's business information to third parties without that user's consent
- Not use contact information obtained through the platform for unsolicited marketing or communications unrelated to platform activities
- Not scrape, harvest, or systematically collect information about other users from the platform
Fairily is not responsible for any misuse of information shared between users on the platform but may take action, including account suspension, against users who violate these confidentiality obligations.
Relationship of the Parties
Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between Fairily and any user. Fairily is an independent platform provider. Organizers and vendors are independent parties who use Fairily to facilitate their own event-related activities. Fairily does not act as an agent, representative, or fiduciary for any organizer or vendor. No user has the authority to bind Fairily to any obligation, contract, or commitment.
Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the practices described in our Privacy Policy.
Electronic Communications
By creating an account, you consent to receive electronic communications from Fairily, including:
- Account notifications (registration confirmation, password resets, security alerts)
- Transaction communications (payment confirmations, receipts, fee reminders)
- Event-related notifications (application status updates, booth assignments, event changes)
- Service announcements (terms updates, maintenance notices, feature changes)
You agree that these electronic communications satisfy any legal requirement that such communications be in writing. You may manage your notification preferences in your account settings, but you cannot opt out of transactional or legal notices while your account is active.
Notices
We may provide notices to you by email to the address associated with your account, by posting within the Service, or by other reasonable means. A notice sent by email is deemed received on the day it is sent. It is your responsibility to keep your email address current. Notices from you to Fairily must be sent to admin@fairily.net and are deemed received when actually received by us.
